Terms of Service

These Terms of Service (the “Terms”) govern your use of Sequence, including setsequence.com, the Sequence dashboard, API, MCP server and capture script (together, the “Service”). The Service is operated by DCS3, LLC (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you use the Service for an organization, you confirm you have authority to bind it, and “you” means that organization.
1. The Service
Sequence lets you and the AI agents you connect create email and SMS templates, audiences, sequences, broadcasts and triggers, and then sends those messages on your behalf. We may add, change or remove features over time.
2. Accounts, keys and AI agents
- You must give accurate account information and keep your password and account keys secret.
- Anything done with your account key, including actions taken by an AI agent you connected, is treated as done by you. Review what your agents set up before it sends.
- Tell us right away at hello@setsequence.com if you think a key or your account has been compromised.
3. Your data and your contacts
You keep all rights to the content and contact data you put into the Service (“Customer Data”). You give us permission to host, process and transmit Customer Data only as needed to provide, secure and support the Service. For the people you message, you decide what is sent and why, and we process their data on your behalf. Our Privacy Policy explains how we handle personal information.
4. Messaging compliance
You are responsible for every message sent from your account, and for following the laws and rules that apply to it, including:
- CAN-SPAM, the TCPA, CASL, GDPR and other laws that apply to your messages and recipients.
- Carrier and industry rules for SMS, including A2P 10DLC registration and CTIA guidelines.
- Having a lawful basis, and for SMS express consent, for every contact you message.
- Never using purchased, rented, scraped or shared lists.
- Identifying your business accurately and honoring opt-outs promptly.
Sequence adds an unsubscribe link and your mailing address to every email, handles STOP replies for SMS, and checks opt-outs before each send. These tools help, but they do not move your legal responsibility to us. To protect recipients and sender reputation, we may automatically pause sending for a brand when complaints, bounces or opt-outs spike, and we may suspend sending that we believe breaks these Terms or the law.
5. Acceptable use
You may not use the Service to:
- Send spam, phishing, malware, or deceptive or fraudulent messages.
- Send content that is illegal, harassing or hateful, or that carriers prohibit for SMS (for example, certain content about cannabis, firearms, gambling or alcohol where restricted).
- Send marketing to people who have opted out, or hide who a message is from.
- Probe, overload or get around the security, rate limits or usage limits of the Service.
- Resell or provide the Service to others as a standalone product without our written permission.
6. Third-party services
We deliver email and SMS through providers such as Resend and Twilio, and you may connect services such as Pipedrive or Zapier. Those services have their own terms. Mailbox providers and carriers decide independently whether to deliver or filter a message, so we cannot guarantee delivery, inbox placement or SMS registration approval.
7. Fees
If you use a paid plan, you agree to the fees on our pricing page when you subscribe, plus applicable taxes. That includes charges for brands, emails and texts beyond your plan’s allowance, and carrier registration and campaign fees for SMS, which we pass through at cost. We will give you reasonable notice before changing the price of a paid plan.
8. Our intellectual property
We own the Service, including its software, design and documentation. If you send us feedback, we may use it without obligation to you.
9. Suspension and termination
You can stop using the Service at any time. We may suspend or end your access if you break these Terms, if your use creates legal or security risk, or if required by law. After termination we will delete or de-identify Customer Data within a reasonable period, except where we must keep it by law. That includes suppression records (unsubscribes, opt-outs and complaints). If you need a copy to honor opt-outs elsewhere, ask us at hello@setsequence.combefore you delete a brand or close your account.
10. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI agents can make mistakes. You are responsible for reviewing the content and settings they create.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.
12. Indemnity
You will defend and indemnify DCS3, LLC against claims arising from your Customer Data, the messages you send, or your violation of these Terms or the law.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Virginia, and both parties consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the Service before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
